This Privacy Policy explains how Utiliko Corporation, a Delaware corporation ("Utiliko," "we," "us"), collects, uses, and shares personal information when you visit utiliko.ai, use Utiliko's trial signup page at https://utiliko.io/free-trial/ (the "Signup Page"), request or use a trial, book a demo, or otherwise contact us (together, the "Sites and Services"). It does not cover the data our customers store in the Utiliko app, which is described in Section 7.

1. Information we collect

Information you give us

Website chat: if you use the chat on our site, your name, email address and the messages you send, so we can answer you.
Trial requests and signups: first and last name, work email, company name, company size, and any other details the form asks for, such as phone number and login details for your trial account.
Demo bookings: name, email, company, the time you choose, and anything you tell us before or during the demo.
Contact and support requests: your name, email, phone number if you give it, and the content of your message.
Billing details for paid accounts: billing contact, billing address, and payment card or bank account details you enter in Utiliko's billing system.
Partner referrals: if a Utiliko partner introduced you, the partner may give us your name, company, and contact details.

Information collected automatically

Device and usage data: IP address, browser and device type, pages viewed, referring page, time and date of visits, and similar log data.
Campaign details: when you arrive from a link or ad, our site stores first-touch campaign details (UTM parameters, partner referral code and the app you came from) in your browser's local storage for up to 90 days, so we can credit the source of a trial signup. We do not send this to advertising platforms. If you used a Utiliko partner's link, we record that partner's referral ID with your signup. See Section 4.

2. How we use information

To set up and run trials and accounts, and to provide the Services.
To respond to requests, run demos, and provide support.
To send service messages about your trial or account.
To send marketing emails and, if you agreed, text messages. You can opt out at any time (Section 6).
To improve our Sites and onboarding, and to see which campaigns and partners lead to signups.
To attribute signups and customers to the campaign or partner that referred them, and to pay our partners.
To bill customers and collect payment.
To protect our Sites and Services, prevent fraud and abuse, and meet legal obligations.

AI assistants. Some sales and support conversations with Utiliko, including demo calls, are handled by an AI assistant so we can answer your questions and show you how Utiliko works.

3. How we share information

We do not sell personal information for money. We share it only as follows:

Service providers that host, support, or help us run the Sites and Services, including cloud hosting and HighLevel (GoHighLevel), the platform that runs our website forms and chat and sends our email and text messages, under contracts that limit their use of the data.
Utiliko partners: if a partner referred you, we may tell that partner whether you signed up or became a customer and share the information needed to calculate and pay its reward. If you bought through a partner that supports your account, we share what that partner needs to support you.
Legal and safety: to comply with law, respond to lawful requests, enforce our terms, or protect rights, property, and safety.
Business transfers: in a merger, acquisition, financing, or sale of assets, subject to this Policy.
With your consent or at your direction.

4. Cookies and local storage

We use only strictly necessary and functional storage on utiliko.ai. When you arrive from a link or ad, our site stores first-touch campaign details (UTM parameters, partner referral code and the app you came from) in your browser's local storage for up to 90 days, so we can credit the source of a trial signup. We do not send this to advertising platforms.

If you use the chat on our site, our chat provider HighLevel stores your chat details, a visitor ID and your visit history in cookies and browser storage for up to 1 year, so our team can recognize you and see which pages you visited when answering your chat. This is not used for advertising. See our Cookies and Consent page for details.

We do not currently use analytics or advertising cookies on utiliko.ai. Before we add them, we will update this policy and our cookie notice and offer any opt-out choices the law requires.

5. Your privacy rights

Depending on where you live (for example, California, Texas, Virginia, Colorado, Connecticut, and other US states), you may have the right to:

know and access the personal information we hold about you;
correct inaccurate information;
delete your information;
get a copy of your information in a portable format;
opt out of the sale or sharing of your information, targeted advertising, and certain profiling; and
not be treated differently for using these rights.

To make a request, email [email protected] or write to us at the address in Section 12. We will verify your request and respond within the time the law requires (generally 45 days). You may use an authorized agent where the law allows. If we deny your request, you may appeal by replying to our decision with the subject line "Appeal." If your appeal is denied, you may contact your state attorney general.

6. Marketing choices

Email: use the unsubscribe link in any marketing email. We will still send service messages about your account.
Text messages: reply STOP to any text to stop receiving them. Reply HELP for help. We send marketing texts only to people who agreed to receive them.

7. Customer data in the Utiliko app

Our customers control the data they put in the Utiliko app, such as their own contacts, tickets, projects, and invoices. We process that data on our customers' behalf under their subscription agreement and our data processing addendum. If your information is in a customer's Utiliko account, please contact that customer about it.

8. Retention

We keep personal information only as long as we need it for the purposes in this policy, including providing our services, meeting legal, tax and accounting obligations, resolving disputes and enforcing our agreements. After that we delete or de-identify it.

9. Security

We use reasonable administrative, technical, and physical measures designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee security.

10. Children

You must be 18 or older to use the Sites and Services. They are for businesses and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child gave us information, contact us and we will delete it.

11. Changes to this Policy

We may update this Policy. We will post the new version with a new "Last updated" date and, for material changes, give notice as the law requires.
